Policy Application

The Policy applies to all members of the Academy including students, staff, faculty, administrators, contractors, service providers, directors, volunteers, and visitors.

The Scope

The Policy applies to complaints of sexual violence occurring inside the Academy facility or during any off-site Academy-related activities, involving members as defined above.

Purpose and Intent

All members of the Academy have the right to study and work in an environment free from sexual violence. This document defines prohibited behaviours and explains the investigative process.

Policy Objectives

The Academy is committed to ensuring an environment free from sexual violence and treating all reports with dignity and respect.

The Academy will:

  • Educate faculty, staff, and students about this policy.
  • Help identify and reduce sexual violence behaviours.
  • Investigate complaints and provide updates to complainants and respondents.
  • Assist victims in obtaining counselling, medical care, and academic accommodations.
  • Provide information on reporting options.
  • Ensure on-campus investigation procedures.

Definition of Sexual Violence

Sexual violence includes any sexual act targeting a person’s sexuality, gender identity, or gender expression without consent. This includes sexual assault, harassment, stalking, voyeurism, indecent exposure, and sexual exploitation.

Reporting and Responding to Sexual Violence

All members must take steps to prevent and report incidents. Reports should be made immediately to the President or Program Director.

Confidentiality will be maintained unless there is risk of harm or legal obligations require reporting.

Complainants have the right to decide whether to involve police, except where the Academy must act to ensure safety.

Investigating Reports of Sexual Violence

Complaints may be filed in writing to the President or Director.

Investigation Steps

  • Determine if the incident requires police involvement.
  • Interview complainant and witnesses.
  • Inform respondent of allegations and allow response.
  • Provide updates to all parties.
  • Decide appropriate disciplinary action.

Students acting in good faith will not face discipline for drug or alcohol use at the time of the incident.

Disciplinary Measures

Individuals found responsible for sexual violence may face termination, suspension, or expulsion. Criminal investigations may run concurrently with internal investigations.

Making False Statements

Knowingly making false allegations is a violation and may result in disciplinary action.

Reprisal

Retaliation against anyone reporting sexual violence in good faith is prohibited.

Irrelevant Questions

Students will not be asked irrelevant questions about past sexual history or expression during an investigation.

Review

This policy will be reviewed periodically and revised as required by provincial guidelines.
